How to enter into Canada with a criminal record？

如果有犯罪记录如何进入加拿大？

 

如果您有犯罪记录（criminal record），也不是绝对不能进入加拿大。加拿大的法律对有犯罪记录的申请人提供了弹性的做法，如果有可信的证据证明申请人不会对加拿大公共安全产生威胁的话。一般有犯罪记录的申请人有如下四种方法可以进入加拿大。

1.持有律师函（legal opinion letter）：

持有律师函并不能免除因犯罪记录导致的加拿大不准入。但是它可以第一时间解释你并不是Canada criminal inadmissible的类型。律师函上列明了您的具体犯罪情形及如何符合加拿大的法律内容。律师函对deemed rehabilitated的类别或者被指控犯罪但是并没有达到inadminsible程度的申请人最为有用（新新源移民）。这种律师函可以由加拿大移民律师起草，The letter explains the legal matter, identifies risks and relevant Canadian law, and explains why you should be deemed admissible to Canada。The letter can explain facts that demonstrate to the Canadian government that you are deemed rehabilitated, or your offense was isolated or not serious, or there is no Canadian equivalent to your offense。这种律师函可以用来支持TRP或者criminal rehabilitation的申请。

A legal opinion letter can be beneficial in a number of individuals, including but not limited to the following:
1) people who may be deemed rehabilitated;

2) people who have been charged but not convicted of a crime, such as those who received a deferral of adjudication or a Nolle Prosequi; and

3) individuals who have been convicted of an offence which does not have an equivalent in Canada.

2. Deemed rehabilitated视同改过（犯罪超过10年）

如果申请人有过不严重的犯罪（non-serious crime），且已经过去10年了，则可以视同改过，恢复如常。这种情况下，申请人已经不属于criminal inadmissible的情况了，一般进出不会有问题（新新源移民）。不会把申请人turn away。去加拿大之前也不需要向加拿大政府提出申请。不过，理论上如此，在经过边境检查站的时候依然可能会遇到问题，如果边境检察官认为申请人依然有安全风险的话。这个时候可以携带一封律师函（如上）解释申请人的具体情形。比如不准入的野蛮驾驶（reckless driving）可以降低到不严重的准入的交通违规（traffic violation）。还有一些比如申请人因拥有大麻而被指控，但是这个量在加拿大是合法的。严重的犯罪，比如酒后驾车（driving under the influence）判刑10年以上的，可能会判定criminal inadmissible（2018年12月起，DUI酒驾最高刑期由5年提高到10年，这在加拿大是非常严重的犯罪，即indictable offence，In theory, anyone who has committed an indictable offence is inadmissible to Canada forever due to serious criminality。当然，即便DUI，也可能通过本文的几种方法克服犯罪不准入加拿大），由于DUI酒后驾车在加拿大是一个很严重的犯罪行为，所以即便过了10年，也不自动变成deemed rehabilitated视同改过。对于不严重的犯罪则加拿大不会不准入。如果2018年12月之前就被deemed rehabilitated，还是可以允许进入加拿大的。律师函可以解释一个罪行不是很严重并且没有达到criminal inadmissible的程度。If you are currently facing a charge of DUI with no prior criminal history, you should not be considered inadmissible to Canada. Canadian immigration officers have discretion in these situations, weighing the benefits and risks of allowing entry.

3. Criminal Rehabilitation犯罪复原（犯罪超过5年，不超过10年）

如果申请人犯罪后完成刑期满5到10年，则可以申请criminal rehabilitation.如果被批准，则申请人过去的罪行将抹除干净。然后进入加拿大将无任何障碍。如果服刑完成超过10年，则申请人属于视同改过deemed rehabilitated（新新源移民），如果只有一个不严重的判罚，则进入加拿大一般不会有问题，有问题的时候请参考如上的deemed rehabilitated情形。如果有多个判罚，则申请人需要申请criminal rehabilitation，使馆或边境检察官会权衡对加拿大公共社会潜在的安全威胁。申请criminal rehabilitation可以永久的解决criminal inadmissibility的问题。一旦获批，只要不有新的犯罪，则申请的人犯罪记录不再会阻止申请人进入加拿大。申请这个必须至少最近的服刑结束满了5年。申请费取决于所犯罪行的严重程度，轻度的是200加币，严重的是1000加币。这种申请有可能需要审核一年。You can do this by providing evidence like demonstrating a stable lifestyle or showing that you have taken steps to improve your behaviour. It also helps if your offense was an isolated event.

4. Temporary Resident Permit 临时居住许可（犯罪不满5年）

TRP对有犯罪历史但是想进入加拿大的申请人的一个临时解决方案。适用于申请人完成最后一个刑期不满5年或者有一个很valid的入境加拿大的理由。TRP有效期一般主要就是申请人在加拿大停留的时间，到期就需要离开加拿大或者重新申请一个新的TRP。TRP有效期最长的可以长达3年。为了有资格获取这个许可，申请人必须详细说服加拿大政府自己的加拿大之行对加拿大的benefits大于risks. TRP是临时进入加拿大的解决方案。申请TRP比申请criminal rehabilitation更快（新新源移民）。当然，有很多申请人选择同时申请TRP和criminal rehabilitation。美国公民或美国绿卡可以当他们到达加拿大边境时申请TRP或者在加拿大使馆得到一个pre-approval。其他国家的外国人必须在加拿大使馆申请，申请费是200加币。Some examples of a compelling reason could be coming to Canada to work, attend business conferences, or for important family events such as a funeral or wedding. Applicants who wish to enter Canada for business or compassionate reasons are more likely to gain a TRP than those wanting to come to Canada for tourism. If you want to come to Canada as a tourist, you might want to apply for another option instead.

这种TRP不保证一定能获批，而且即便获批，官员随时有权取消申请人的TRP。一旦离开加拿大，则TRP无效（除非已经specifically pre-authorized）。如果申请人是driving while impaired（也是酒后驾车），则进入加拿大也需要申请这种TRP.
