【海牙&使馆】2024年使馆认证&海牙认证基本说明及流程
(一）使馆认证
也叫使馆认证、领事认证、使馆加签，英文名叫Legalization。是指一国外交机构及其授权机构在涉外文书上确认所在国公证机关或某些特殊机关的印章或该机关主管人员的签字属实。领事认证不对公证书或者其他证明文书证明的事项行使证明职能，不对文书内容本身的真实性、合法性负责，文书内容由文书出具机构负责。经过认证的证书具有法律效力，可为文件使用的有关局承认。
大使馆认证主要包括民事认证和商业认证，民事认证，如婚姻状况、出生、身份、亲属关系、学历、收入证明等;商业认证，如产地证明、形式发票、提单、保险、营业执照、合同，出口商注册表和授权书、价格单、箱单、报关单、发票和产地证等。既要做“外交部认证”，又要做”使馆认证“，也称“双认证”。使馆认证限于两国之间，使用范围相对窄。
(二）海牙认证
又称apostille，这种认证适用于海牙公约成员国。Apostille认证是指由国际政府机构统一出具的，对原认证的签发人进行的二级认证，并在认证书上加盖印章或标签，这个过程就叫做apostille认证加签即海牙认证。
海牙认证是海牙成员国之间对跨国使用文件进行鉴定程序便捷化的一种方式，简单来说就是一份文件，如果做完海牙认证，就可以在其他海牙成员国使用了。也就是在海牙协议国之间，只需要做一份海牙认证即可在所有海牙协约国使用，而不用分别做各个国家的使馆认证。海牙协约国有100多个国家，如果使馆认证需要做100多份，而海牙认证只需要做1份即可。区别于使馆认证的双认证，它是单认证的，它不经过外交部和使馆，只由国际律师+海牙法院签发。比如香港，由香港国际公证人进行公证，拿到香港高等法院进行认证并加盖apostille章。

In accordance with the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China and the Basic Law of the Macao Special Administrative Region of the People's Republic of China, the Government of the People's Republic of China has decided that the Convention will continue to apply to the Hong Kong Special Administrative Region and the Macao Special Administrative Region of the People's Republic of China. In accordance with Article 6 of the Convention, it designates each of the following as the competent authorities in the Hong Kong Special Administrative Region to issue the certificate referred to in the first paragraph of Article 3 of the Convention: the Administrative Secretary, the Registrar of the High Court, the Senior Deputy Registrar of the High Court and the Deputy Registrar of the High Court of the Hong Kong Special Administrative Region. In accordance with Article 6 of the Convention, it designates each of the following as the competent authorities in the Macao Special Administrative Region to issue the certificate referred to in the first paragraph of Article 3 of the Convention: the Secretary for Administration and Justice, the Director and the Deputy Directors of Justice Affairs Department of the Macao Special Administrative Region. The other Declarations previously made by the Government of the People's Republic of China for the Hong Kong Special Administrative Region and the Macao Special Administrative Region continue to be effective.
4. The Declaration made by the Government of the People's Republic of China that "the Convention will not be applicable between the People's Republic of China and those Contracting States that China does not recognize as sovereign states" applies to the Hong Kong Special Administrative Region and the Macao Special Administrative Region.

(三）香港认证
香港不像国内，在香港没有公证处，香港公证通常指三种：（1）在香港本地使用的香港律师公证；（2）在大陆使用的中国委托公证 (China Attestation)；（3）到世界各国使用的国际公证 (Notary Public)。因此根据文件适用地区的不同，办理不同类型的公证。
香港的文书拿到香港以外（除中国内地）使用，分三种情况：
1.拿到海牙公约组织成员国使用，则只需要先由香港国际公证人公证，然后送交香港高等法院认证（也叫加签），即可使用，这是办理海牙认证；
2.拿到非海牙公约组织成员国使用，需要先由香港过国际公证人公证，然后送交香港高等法院认证，最后拿到使用国驻香港领事馆认证（使馆认证）；
3.如果该国在香港没有领事馆，则需要将高院加签后的文件送中国外交部驻港特派员公署认证，然后送该国驻北京大使馆认证（使馆认证）。
对于以上第二种香港大陆委托公证 (China Attestation)，由中国委托香港公证人出具，中国委托香港公证人名单如链接： http://www.caao.org.hk ；对于第三类的国际公证 (Notary Public)（海牙认证或者使馆认证，会用到香港国际公证人，其名单可以查看 http://www.notaries.org.hk/en/Public/SearchforNotariesPublic.aspx ）。
