Which entities in the Russian Federation are responsible for affixing the apostille?

ADMINISTRATION OF JUSTICE

He affixes the apostille on judicial and notarial deeds. Examples of mostly apostilled documents:

·         judgments (convictions, dispositions) of the courts. To affix the apostille on judicial acts it is necessary that they become res judicata . For example, on a sentence of first instance, if the appeal deadline has not expired, the apostille cannot be affixed until the stamp “res judicata on date ” appears ;

·         notary consents for the expatriation of children;

·         notary consents of the spouse (former spouse) for transactions;

·         notarial powers of attorney;

·         contracts authenticated by the notary (for example, marriage agreements, alimony payment agreements, agreements to define the methods of participation in the education of the child, agreement for the separation of joint property of the spouses, etc.).

IMPORTANT ! The apostille at the Administration of Justice can be affixed both to the originals and to notarized copies of the above documents.

ROSOBRNADZOR (Federal Service for the Control of Education and Science) (Moscow Department of Education).

He affixes the apostille on the originals of the degrees issued in the Russian Federation, as well as in the RSFSR (Russian Socialist Federative Socialist Republic) in the period in which the USSR existed.

Examples of academic qualifications on whose originals it is possible to affix the apostille:

·         school diplomas with their attachments;

·         professional education diplomas with their annexes;

·         degree diplomas;

·         doctoral degrees;

·         second degree doctoral degrees.

IMPORTANT ! The apostille at the Rosobrnadzor is placed only on the originals of the above qualifications.

IMPORTANT! The apostille can also be affixed to a diploma from a non-state institution. The important thing is that the institute has state accreditation and issues diplomas of conventional state model. In practice, most of the time requests for affixing apostille on this type of documents are rejected precisely because of errors in the model, of an unconventional type, with incorrect formation and drafting of the document.

IMPORTANT! Various certificates (including academic certificates), certifications, study plans, attestation of studies (of any type of courses, professional updating, etc.) are not apostilled on the originals!

In this way, it turns out that the aforementioned educational qualifications (high school diploma and degree) can be apostilled in two ways: by affixing the apostille on the original or on the notarized copy of the document.

If the apostille is placed on the original, the body in charge is the Rosobrnadzor, if on the notarized copy the Administration of Justice.

ARCHIVE ZAGS (Civil Status Office).

Affixes the "Apostille" stamp on the state registration documents of civil status documents. This category of documents includes:

·         certificates (notifications) of conventional model. The most requested certificate is Model 35 (Notification of absence of transcription of the state registration of the civil status deed).

·         This certificate, as a rule, is necessary to confirm that you are not married (i.e. that the applicant is not single), if the Russian citizen intends to marry outside the Russian Federation.

·         acts (of marriage, dissolution of marriage, birth, death, change of name, sex, acknowledgment of paternity, maternity, adoption).

IMPORTANT ! The apostille at the ZAGS archive is only affixed to the originals of the above documents. If, on the other hand, it is necessary to affix the apostille on the notarial copy of deeds (certificates) issued by ZAGS bodies, in this case the body in charge is the Administration of Justice.

MINISTRY OF THE INTERIOR.

He affixes the “Apostille” stamp on the originals of the documents issued by the main analytical-information centers of the Ministry of the Interior for Russia.

In general, we speak of certificates of absence (presence) of pending proceedings.
