Note 1:
If you had left Vietnam, but don’t live at your home country, and live abroad, it’s most likely that the Vietnamese embassy at the country you’re living in don’t accept to certify for you directly. You need to come to embassy of your home country to certify first, then come to Ministry of Foreign Affairs of the country you’re currently living at to certify, then finally come to Vietnamese embassy to certify. For example, if you are British living in Japan, you need to come to British embassy to certify first, then go to Ministry of Foreign Affairs of Japan to certify, then finally go to Vietnamese embassy to certify. There is exception that they would certify for passport holder from a 3rd country, but not all the times.

a) Vietnamese citizens whose permanent or temporary residence cannot be identified;

2. The Department of Justice shall issue judicial record cards in the following cases:

The judicial record is granted in Vietnamese. If you want an English translation, you may make a request when you receive your Vietnamese judicial record.
Request for a "Justice Record Check #1" (Phieu Ly Lich Tu Phap So 1) must be made at the National Center of Criminal Records - Vietnamese Ministry of Justice in Hanoi. Contact information is as follows:

The processing fee to request this document is 200.000VND per applicant, and the record check takes approximately 10 working days to complete. If applicant cannot present himself/herself at the National Center of Criminal Records, he/she can grant authority to someone else to apply on his/her behalf as long as he/she provides a Letter of Attorney which is legalized/ authenticated by Vietnamese Consulate General or Vietnamese Embassy at the city of their current residence.
Applicant should be prepared to present two (2) sets of the following documents at the time of the request:
Completed application form (Form 03/TT-LLTP.) if applicant can apply in person, or completed application form (Form 04/TT-LLTP) if applicant cannot apply in person and authorizes someone else to apply on his/her behalf;
Applicant's passport;
Proof of residence location and length of time applicant resided in Vietnam, such as his/her old entry-exit permit detailing the length of time applicant resided in Vietnam, the permanent residence card, if any, or a residence certification from the local People's Committee of applicant's residence.
There are two main types of Vietnam Criminal Record/ Police Check Certificate
Certificate of Police Check/ Criminal Record Card No. 1, which shall be issued to Vietnamese citizens and foreigners who resided or are currently residing in Vietnam, state agencies, political organizations and socio-political organizations may request the issuance of Police Check Certificate to serve the personnel management, business registration, establishment and management of enterprises or cooperatives;
Certificate of Police Check/ Criminal Record Card No 2, which shall be issued to Procedure-conducting agencies may request the issuance of Police Check Certificate to serve the investigation, prosecution and adjudication work and at the request of individuals who want to know their judicial records.
What are the differences between police check certificate No.1 and police check certificate No.2?
The differences between these two types are that he Criminal Record Form No.1 only records sentences that have not been removed. If the case has been deleted, it will state “no criminal record”. Criminal Record Form No. 2 records all previous criminal convictions regardless of whether it was deleted or not.
Depending on the purpose of use, either Criminal Record Form No. 1 or Criminal Record Form No. 2 would be required. Criminal Record Form No. 1 is commonly required for the issuance Work Permits for foreign individuals to work in Vietnam.
What really happened? And why?
While I can’t answer your questions as I’m not the authority, I can give you some insights and information based on my experiences:
1. If you make payment by bank transfer, you need someone to help you to call them to ‘match’ the payment with the application.That person need to be able to say on which day your application arrives, and which day your payment is made, then approximately which day the payment is arrived into their account. If not, they won’t be able to verify quickly which payment belong to which application, and your application process may take forever.
2. There is possibility that you thought you made enough payment, but it wasn’t. Specially if you do bank-to-bank transfer, your bank charges you a fee to send, and you think that’s all. However, when the amount arrives in their bank in Vietnam, their bank also charges them an amount to receive, which make your payment not enough. Thus, you need help from someone to call them to verify if the payment is enough, and make additional payment if needed.
There are some more cases, but these two are the most basic.
3.2 Methods of paying the fees:
Payers can choose one of the following three payment methods for criminal
record certificates and the postal service:
(1) Transfer to the bank account of the Department of Justice. Any payment
in foreign currency shall be converted into Vietnam Dong at the prevailing interbank
exchange rate at the date of submission.
(2) Directly pay in cash at the Department of Justice (Vietnamese currency
only).
(3) Transfer money through postal service when submitting application
dossier for criminal record certificates along with the fee transfer receipt to the
Department of Justice (Vietnamese currency only).
4.3.Time limit for issuance of criminal record certificates:
- No later than 10 working days after the receipt of a valid dossier.
-No later than 15 working days after the receipt of a valid dossier in cases:
The applicant is (1) a Vietnamese citizen residing in many places or abroad; (2) a
foreigner; (3) subjected to verification of default conditions for removing previous
criminal convictions.
- Recipients of criminal record certificates number 2: Requesters for criminal
record certificates number 2 must receive their certificates in person.
To collect criminal record certificates, an individual shall submit the return
confirmation sheet and his/her identity card or passport.
If an individual directly applies for criminal record certificates but authorizes
another person(s) to collect the certificates, the authorized person must submit the
certified authorization letter in addition to the document mentioned above (11)

Parents, spouse and child of the requester can receive the criminal record
certificates without authorization letter but they must show the certification of
relationship such as marriage certificate, certificate of birth, etc.
(7) (11) Certified at legal notary offices or authorities in Vietnam or
Vietnamese diplomatic or consulate agencies abroad
In case the authorization is done as stipulated by the law of the country
where that person is a citizen or resides, the authorization letter shall be legalized
and translated into Vietnamese, except for cases of exemption from certification/
legalization in accordance with the International agreement to which Vietnam and
such foreign country are the parties or on the principle of reciprocity or in
compliance with regulation of the Law of Vietnam.

申请人在澳洲使馆办理无犯罪的案例2019年
okay. so i am just gonna write what i have done FYI, because i was struggling with this retarded work.
so i filled out the forms 03 04 and another one for recipient of this documents. i went to the consulate general of vietnam that was located in Edgecliff, Sydney.
that person working there told me i have 2 options.
1. i mail these forms to VN by myself. then after a month they will contact me with the fees i have to pay.
or 2. i pay 400 AUD there, then i will receive it in 10 days.
so, no offence but i know how THEY WORK, i decided to pay 400 AUD which was about 6.5tr VND. yes ingot ripped off but i feel much safer. because I dont have to worry about any VN risks (any risks that may occur such as missing documents from there, no contact, days it will take)
and my agency received it in a week.
400 was too big, because it only costs like 100k or something VN that i have done it before. and the express mail was about 80 or something (i checked at the post office downstair)
so their document processing fee was like 250.
but if i was not in such a rush, then i would do the first way.

I applied the Vietnam police check (No. 2) few months ago from Canada, and got it in about 2 months, the normal process would take less than 2 months.

Your wife need to fiil out the Police check application form, copy of passport (info page), and a credit authorization form, send all these documents to Vietnam Embassy at Ottawa. They will send back to you the notarized police check application form and notarized passport in abt 1 week after received the docs. Remember to choose the guaranteed mail service. The fee for this notarization is around CAD 160.
When you receive these documents, you can send back to Department of Justice of Ho Chi Minh City (if your wife resided in Ho Chi Minh City), including the 2 forms you got from Vietnam Embassy, plus 1 A4 page showing all the information of the person who's living in Vietnam that can pay the fee for your wife, and the address to receive the police check. Please state all the information of that person (address, tel phone, relationship, etc). Department of Justice of Ho Chi Minh City receives your envelop, will contact that person to pay the fee, then they will proceed (takes 3 weeks) and send the police check to your address here in Canada. When your friend/ family pays the fee, please ask Department of Justice of Ho Chi Minh City to translate to English.

I got mine through them, you just need to download the forms (application form + credit card authorization form) - the form i filled was in Vnese tho so maybe you should switch it to Eng, or you just simply call them to request for an Eng ver, then send them back to visa@vietnamembassy.ca
